Terms of Use

These Terms of Use ("Terms") govern your access to and use of forterisrisk.com (the "Site"), operated by Forteris Risk and Compliance Group, LLC ("Forteris," "we," "us," or "our"). By accessing or using the Site, you agree to be bound by these Terms.

Attorney Review Recommended These Terms were drafted as a starting template using widely-used language for U.S. professional services firms. 1. Acceptance of these Terms

By accessing or using the Site, you represent that you are at least 18 years of age and have the legal capacity to enter into these Terms. If you do not agree to these Terms, you must not access or use the Site.

2. No professional advice

The content on the Site is provided for general informational purposes only and is not intended as, and should not be relied upon as, legal, financial, accounting, tax, investment, regulatory, or other professional advice. Forteris is not a law firm and does not engage in the practice of law. Reading information on the Site, submitting an inquiry, or otherwise communicating with Forteris does not create an attorney-client, fiduciary, accountant-client, or other professional relationship.

A professional engagement is created only by a written engagement letter signed by both you and Forteris. You should not act, refrain from acting, or make any business or legal decision based on information on the Site without consulting qualified professionals about your specific circumstances.

3. No solicitation in restricted jurisdictions

The Site is intended for users in the United States. Forteris does not target or solicit business from individuals in jurisdictions where doing so would be prohibited. The descriptions of our services on the Site are not, and should not be construed as, offers to provide services in any jurisdiction where Forteris is not authorized to do so.

4. Intellectual property

All content on the Site — including text, graphics, logos, the Forteris name and marks, images, software, and the selection, arrangement, and design of the Site — is the property of Forteris or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws.

You may view and print pages from the Site for your own personal, non-commercial reference. "Forteris," "Forteris Risk & Compliance Group," the Forteris logo, and related names and logos are trademarks or service marks of Forteris Risk and Compliance Group, LLC. You may not use these marks without our prior written permission.

  • Use the Site in any manner that could disable, overburden, damage, or impair the Site or interfere with any other user's access;
  • Use any robot, scraper, spider, or other automated means to access the Site for any purpose without our prior written consent;
  • Attempt to gain unauthorized access to any portion of the Site, our systems, or accounts of other users;
  • Use the Site for any purpose that is unlawful, fraudulent, or prohibited by these Terms;
  • Introduce any virus, trojan horse, worm, logic bomb, or other malicious or harmful material; or
  • Use the Site to harvest personal data, send unsolicited communications, or engage in any form of advertising without our written consent.

7. Inquiries and submissions

If you submit an inquiry, question, comment, or any other communication to Forteris through the Site or by email, you represent that you have the right to do so and that the submission does not violate any third party's rights. Forteris does not assume any obligation of confidentiality with respect to unsolicited communications unless and until a written engagement letter is signed. Do not send confidential, privileged, or sensitive information until a professional engagement has been formally established.

8. Third-party links and content

The Site may contain links to websites or resources operated by third parties. These links are provided for convenience and do not constitute our endorsement of those sites or any products, services, or information provided by them. Forteris is not responsible for the content, accuracy, or practices of any third-party site, and you access them at your own risk.

9. Disclaimer of warranties

THE SITE AND ALL CONTENT, MATERIALS, AND SERVICES PROVIDED ON OR THROUGH THE SITE ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, FORTERIS DISCLAIMS ALL WARRANTIES, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

FORTERIS DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS, OR THAT THE CONTENT ON THE SITE IS ACCURATE, COMPLETE, OR CURRENT.

10. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL FORTERIS, ITS MEMBERS, OFFICERS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF, OR INABILITY TO USE, THE SITE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STATUTE, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT FORTERIS HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

Verify before publishing The limitation of liability language above is broad and standard for informational professional services websites. If you plan to offer services with monetary thresholds, you may want to cap liability at the fees paid by a client over a defined lookback period. An attorney should advise on what is enforceable in Florida and the jurisdictions where you serve clients, and whether you want an arbitration provision in lieu of court litigation.

11. Indemnification

You agree to indemnify, defend, and hold harmless Forteris and its members, officers, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your access to or use of the Site; (b) your violation of these Terms; or (c) your violation of any rights of any third party.

12. Governing law and jurisdiction

These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of laws principles. You agree that any legal action or proceeding arising out of or related to these Terms or the Site shall be brought exclusively in the state or federal courts located in Palm Beach County, Florida, and you consent to the personal jurisdiction of those courts.

13. Changes to these Terms

Forteris may modify these Terms at any time by posting an updated version on the Site. The "Last updated" date at the top of these Terms indicates when the most recent revision took effect. Your continued use of the Site after any such change constitutes your acceptance of the revised Terms.

14. Severability

If any provision of these Terms is held by a court of competent jurisdiction to be invalid, illegal, or unenforceable, the remaining provisions will remain in full force and effect, and the invalid provision will be modified only to the extent necessary to make it valid and enforceable.

15. Entire agreement

These Terms, together with our Privacy Policy and any written engagement letter between you and Forteris, constitute the entire agreement between you and Forteris with respect to the Site and supersede all prior or contemporaneous communications, whether electronic, oral, or written, between you and Forteris with respect to the Site.
